Missouri Supreme Court to consider immigrant adoption case

The Missouri Supreme Court is taking up the case of a woman from Guatemala who says she did not consent to her son’s adoption by a southwest Missouri couple.

The high court will hear arguments in the case next Tuesday.

The boy now is 4 years old. He was adopted in 2008 after his biological mother, Encarnacion Romero, got caught up in an immigration sweep at a Barry County poultry plant.

Romero has been seeking custody since being released from jail on immigration violations.
Seth and Melinda Moser of Carthage argue their adoption of the child was legal. An appeals court overturned a lower-court decision that gave custody to the Mosers.

Japanese gang runs adult 'adoptions'

YOKOHAMA, Japan, Nov. 2 (UPI) -- An organized criminal enterprise is suspected of running a phony adult adoption business in Japan to help people get passports and loans illegally, police said.
Kanagawa prefectural police said in Yokohama 197 adoptions of 60 men and women, ages 30 through 60, took place in Tokyo and Kanagawa between February 2001 and August 2007, Japan's Yomiuri Shimbun newspaper reported Tuesday.

Police say the scheme is probably based on the fact that a person's name would be changed after being adopted. The members of the organization could then illegally sell them passports.

The newspaper said the Family Registration Law and the Civil Code allow people to legally enter a parent-child relationship, regardless of their relationship. In adopting an adult, all that is required is an application form with the signatures and seals of the adoptive parent, the signature of the person being adopted and those of witnesses, and copies of their family registers. There is no legal limitation on the number of adoptions one can perform.

Thus, it is easy to be adopted, change names and get loans, even if the person is heavily in debt, the newspaper said.
Police said a 39-year-old South Korean woman, who was in Japan illegally, was arrested last year on suspicion of having a passport under the name of a 34-year-old Japanese woman. The Korean woman was deported.
The Japanese woman whose passport the Korean woman possessed admitted she was involved in getting the passport, police said.

"I have a lot of debt, so I had to change my surname so I could take out a new loan and for other reasons. I've been involved in nine adoptions so far. My adoptive fathers have been people involved with a gang, and some have been total strangers to me," the Japanese woman said.

"I gave my personal seal registration card and health insurance card to somebody involved with the gang, and they gave me 30,000 yen ($372) in return. I have no idea who is using a passport with my name on it," the woman said.

Safe Havens Didn't Save These Babies

READING, Pa., Oct. 25 (UPI) -- A Pennsylvania woman accused of hiding the remains of five of her children, infants at the time of their death, was charged Monday with one count of homicide.

Authorities said DNA testing revealed Michele Kalina, 44, was the mother of all five babies and that at least three of them were the result of an extramarital affair with a boyfriend, WFMZ-TV, Allentown, Pa., reported.

Kalina allegedly hid the bodies in a closet in her Reading apartment where she lived with her husband and teenage daughter.

The daughter discovered the remains and notified authorities. Investigators determined the daughter had unknowingly discarded one set of remains, which were later recovered from a landfill.

"These remains were all badly decomposed skeletal remains," Berks County District Attorney John Adams said. "Four of the human remains were term birth, post-natal death due to non-natural, violent cause and means consistent with asphyxia, poisoning or neglect."

Investigators said they believe Nurse's aide Kalina acted alone, and that she lied to her husband and boyfriend to keep her pregnancies a secret.

"She'd indicated to her boyfriend that she had had ovarian cysts," Adams said, "and that is why she began to show."

Adams said she may be charged for each infant's death later, depending on trial strategy.
Kalina has been jailed since her arrest in August.

A NURSES AID...means she probably worked in a hospital;? Hospitals ARE safe havens!  Yet she hid her pregnancies and tried to hide all evidence of having been pregnant without any concern for the lives of the babies. A nurses aid who apparently did not know about birth control either!!

But this is in keeping with the criticism of Safe Haven baby dumps. Infants at risk for infanticide will not be saved by making abandonment legal!

    Giving a child a strong foundation -- a home, a family to love, and a safe place to grow -- is one of life's greatest and most generous gifts.  Through adoption, both domestic and international, Americans from across our country have provided secure environments for children who need them, and these families have benefited from the joy an adopted child can bring.  Thanks to their nurturing and care, more young people have been able to realize their potential and lead full, happy lives.  This year, we celebrate National Adoption Month to recognize adoption as a positive and powerful force in countless American lives, and to encourage the adoption of children from foster care.

    Currently, thousands of children await adoption or are in foster care, looking forward to permanent homes.  These children can thrive, reach their full potential, and spread their wings when given the loving and firm foundation of family.  Adoptive families come in many forms, and choose to adopt for different reasons:  a desire to grow their family when conceiving a child is not possible, an expression of compassion for a child who would otherwise not have a permanent family, or simply because adoption has personally touched their lives.  For many Americans, adoption has brought boundless purpose and joy to their lives.  We must do all we can to break down barriers to ensure that all qualified caregivers have the ability to serve as adoptive families.

    This year, on November 20, families, adoption advocates, policymakers, judges, and volunteers will celebrate the 11th annual National Adoption Day in communities large and small.  National Adoption Day is a day of hope and happiness when courthouses finalize the adoptions of children out of foster care.  Last year, Health and Human Services Secretary Kathleen Sebelius was honored to preside over a ceremony celebrating two foster care adoptions as part of my Administration's support for this important day.

    Adoptive families are shining examples of the care and concern that define our great Nation.  To support adoption in our communities, my Administration is working with States to support families eager to provide for children in need of a place to call home.  The landmark Affordable Care Act increases and improves the Adoption Tax Credit, enabling adoption to be more affordable and accessible.  As part of the Adoption Incentives program, States can also receive awards for increasing adoptions and the number of children adopted from foster care.  AdoptUsKids, a project of the Department of Health and Human Services, offers technical support to States, territories, and tribes to recruit and retain foster and adoptive families; provides information and assistance to families considering adoption; and supports parents already on that journey.  I encourage all Americans to visit AdoptUsKids.org or ChildWelfare.gov/Adoption for information and resources on adoption, including adoption from foster care.

    As we observe National Adoption Month, we honor the loving embrace of adoptive families and the affirming role of adoption in the lives of American families and our country.  Let us all commit to supporting our children in any way that we are able -- whether opening our hearts and homes through adoption, becoming foster parents to provide quality temporary care to children in crisis, supporting foster and adoptive families in our communities and places of worship, mentoring young people in need of guidance, or donating time to helping children in need.  Working together, we can shape a future of hope and promise for all of our Nation's children.

Kevin Cohen Guilty: Facing 92 Years

NY attorney guilty in $300K adoption scheme



A New York attorney who advertised himself as an adoption expert has been convicted of stealing more than $300,000 from prospective parents for babies that did not exist.

Adoptee and attorney Kevin Cohen was convicted Monday in Nassau County Court of grand larceny, forgery and other charges. He faces up to 92 years in prison.

Prosecutors say Cohen, a Roslyn attorney, scammed hopeful couples with fake sonograms and fictitious records on forged stationery from hospitals and doctors. Thirteen prospective parents testified against him at his three-week trial.

Cohen, who represented himself, says he suffers from multiple illnesses including bipolar disorder and was undermedicated at the time.

Cohen was found guilty of using fake sonogram pictures and report son forged hospital stationary for babies that didn't exist.

But isn't it interstesing that this got proecuted and he faces such a stiff penalty for ruipping people off for money. And those who rip mothers off by duping them inorder to obtain their baies get off scott free!

Rod Stewart still harbors regret over his decision to give his firstborn child up for adoption, but he’s convinced he would have failed to provide her with a “halfway decent” life.

The singer was just 17 when his girlfriend Susannah Boffey gave birth to their daughter Sarah, and the couple decided to give the baby away.
Stewart has since had six more children with various partners, but he still feels anguish about his lost daughter.

When asked if he regrets the decision, he tells broadcaster Piers Morgan, “There’s no way we could have given her a halfway decent start in life. Yeah, I certainly do (regret it). I missed it but we are seeing each other now and we’re trying to make amends for what went on. She had parents for 70 per cent of her life. She’s only just lost her adoptive parents so there was no point in me shouting it from the rooftops, ‘I’m her father!’ We all kept it quiet.”
The Maggie May hitmaker has reconciled with 46-year-old Sarah and they are now trying to forge a relationship, but he admits it hasn’t been easy.

Stewart adds, “It’s somewhat rocky, you know. I think I’ve got to sit down and I think you’ve just got to just open up. If we’re going to get on, and you’re going to get on with my kids, you’ve got to open up, be more friendly, be more cordial. So we’re really working hard at it.

“In fact, I gave her my email address the other day so that’s a big, big plus. I love emailing my kids. It does bond the family together. You can say things that otherwise you might have said on the phone in haste and regretted. I can do my emails and think, ‘Does that look right? Are they going to read that the wrong way?’ and adjust.”

At 65, Stewart is preparing to become a father again – the rocker’s wife Penny Lancaster is pregnant with his eighth child.
